Notexa Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website at notexa.ai (the "Site"), operated by Notexa Inc., a North Carolina corporation with its address at 4030 Wake Forest Rd, Ste 349, Raleigh, NC 27609 ("Notexa", "we", "us"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. About the Site

The Site provides general information about Notexa and links to download the Notexa app from Google Play and the Apple App Store. The Notexa app and any Notexa device are governed by separate terms that you accept when you download, install or purchase them. These Terms do not apply to the app or the device.

2. Use of the Site

You may use the Site only for lawful, informational purposes. You must not:

attempt to gain unauthorized access to the Site or interfere with its security or operation;
use bots, scrapers, or other automated means to access or collect data from the Site, except as permitted by its robots.txt file;
use the Site to transmit malware or any unlawful, harmful or infringing material;
copy, modify, or distribute Site content except as permitted by these Terms.

3. Intellectual property

The Site and its content, including text, graphics, images, the Notexa name and logos, are owned by Notexa or its licensors and are protected by law. We grant you a limited, revocable, non-exclusive license to view the Site for personal, non-commercial purposes. Google Play and the Google Play logo are trademarks of Google LLC; App Store and the Apple logo are trademarks of Apple Inc.

4. Information on the Site

Content on the Site is provided for general information only. Product descriptions, features, screenshots, and images are illustrative, may differ from the actual product, and may change without notice. Nothing on the Site is an offer to sell or a binding commitment.

5. Third-party links and services

The Site contains links to third-party services, including Google Play and the Apple App Store, and is hosted on Shopify. We do not control and are not responsible for third-party services. Your use of them is governed by their own terms and privacy policies.

7. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE AVAILABLE, ACCURATE, OR ERROR-FREE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOTEXA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, AND OUR TOTAL LIABILITY RELATING TO THE SITE WILL NOT EXCEED USD 100. Some jurisdictions do not allow these limitations, so they may not apply to you.

9. Governing law and disputes

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. Any dispute relating to the Site will be resolved exclusively in the state or federal courts located in Wake County, North Carolina. If you are a consumer in the EEA or the UK, you also retain the mandatory protections under the law of your country of residence.

10. Changes and general terms

We may update these Terms by posting a new version on the Site; the "Last updated" date shows the latest revision, and continued use of the Site means you accept it. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver.
